8-25-21 “The California trial pitting an elderly cancer victim against Monsanto owner Bayer AG has been delayed due to concerns about the spread of Covid-19, with proceedings now expected to resume next week in a virtual format via Zoom. Lawyers for plaintiff Donnetta Stephens say that she was a regular user of Monsanto’s glyphosate-based Roundup herbicide for more than 30 years, an extended exposure that caused her to develop non-Hodgkin lymphoma (NHL). Before the trial interruption jury members heard expert witness testimony from former U.S. government scientist Christopher Portier, who told jurors of multiple scientific studies that support claims glyphosate herbicides cause NHL. 11-10-2020- “A court-appointed mediator on Monday said Bayer AG has made “substantial progress” toward resolving tens of thousands of remaining claims that its Roundup weedkiller causes cancer. The mediator Kenneth Feinberg spoke at a Zoom hearing in San Francisco federal court, where a judge still oversees nearly 2,000 unresolved cases over glyphosate-based Roundup, which Bayer acquired with its purchase of Monsanto. Other cases are in state courts.“We’re not there yet but we are certainly making substantial progress,” said Feinberg, who oversaw compensation programs for victims of the Sept. 11 attacks and 2010 Gulf of Mexico oil spill. “It’s just a question of when and how quickly they’ll get resolved.” U.S. District Judge Vince Chhabria had previously paused the federal litigation and given Bayer until Nov. 2 to settle. Ahead of its release of an earnings statement Tuesday, Bayer disclosed in a court filing that 1,861 cases out of about 3,787 lawsuits aren’t controlled by agreements with plaintiffs’ lawyers. 9/24/2020- ” Lawyers for Monsanto owner Bayer AG and for plaintiffs suing Monsanto told a federal judge on Thursday that they were continuing to make progress in settling sweeping nationwide litigation brought by people who claim Monsanto’s Roundup caused them to develop cancer. In a video hearing, Bayer lawyer William Hoffman told U.S. District Judge Vince Chhabria the company had reached deals – or was close to reaching deals – to resolve more than 3,000 lawsuits that are grouped together in multidistrict litigation (MDL) filed in U.S. District Court for the Northern District of California. The company separately has already settled thousands of cases outside the MDL, cases that have been proceeding through state courts. Even though the verdict against it had been reduced, Monsanto had indicated an intent to appeal the verdict to overturn the amended verdict against it. The company stated that it disagreed with the scientific evidence that was presented at trial that was part of the basis for the jury verdict against Monsanto.
